GENERAL SALES TERMS
RESERVATIONS & PAYMENT TERMS
1.1 Any booking will be maintained and considered firm only upon reception of written confirmation by post, fax or email & after immediate payment of the first deposit of 30% of the total estimated price of the services such as defined on the order form, followed by full payment up to 30 days prior guests arrival of the total price of the services listed on the order form receipt of the all supplements that may have been provided to the client has to be paid directly on site by the client except specific agreement with Paris sur Scènes
1.2 Each payment request will be satisfied by Client Company spontaneously, and on first request by Paris sur Scènes
1.3 All sums remaining unpaid at the date mentioned on the invoice or order form lead to the application of penalties of an amount equal to one and a half times the legal interest.
1.4 All payments must be sent to Paris sur Scènes by swift bank transfer or bank draft in Euros to our account
1.5 All services are payable in Euros, Paris sur Scènes cannot be held responsible in any way for the possible variation in the rate of Euros compared to the client’s company currency.
RELEASE OF RESPONSIBILITY “FORCE MAJEURE”
Paris sur Scènes or the client company will be released of all responsibility if the organization of the event cannot be performed whatever the date of cancellation, in case of circumstances outside its control.
The following is a list of “force majeure”events considered as outside Paris sur Scènes or the client company control, releasing it from its obligation to perform the event, namely:
War in France or client’s company country, riots, fire
strikes including transport(planes, train, boats)
natural disaster (flood, earthquake, storm, etc)
In such circumstances, the supply of services can be cancelled on request of either party.
In case of a “ force majeure ” Paris sur Scènes will attempt on clients behalf to obtain any possible refunds of deposits from service providers.
Any cancellation, either partial or total, made by the client (except force major as specified in paragraph 4), involves the application of the following charges by Paris sur Scènes
Client company will be notified of any cancellation charges applied by service providers above the percentage level specified below which will be deducted from all refunds except from the 10% Paris sur Scènes fees
1 TOTAL PROGRAM CANCELLATION (EXCEPT SPECIFIC CONDITIONS GIVEN BY SUBCONTRACTORS)
D= starting date of program
Basis = total amount of services as it is listed on the ORDER FORM
Between 45 &30 days = 15% of total amount of the services as it is listed on the ORDER FORM
From D-30 to D-21 = 25% of total amount of the services as it is listed on the ORDER FORM
From D-20 to D-15 = 50% of total amount of the services as it is listed on the ORDER FORM
From D-14 to D-08 = 75% of total amount of the services as it is listed on the ORDER FORM
From D-07 to D-03 = 90 % of total amount of the services as it is listed on the ORDER FORM
Less than 3 days = 100% of total amount of the services as it is listed on the ORDER FORM
In case of total cancellation of a program for any reason including “ force majeure ” more than 46 days before arrival Paris sur Scènes will be entitled to claim an amount of 5% administrative fees above supplier’s cancellation penalties. These 5% will be calculated on the total amount of services as it is listed on the ORDER FORM to cover time spent on development of the program.
2 PARTIAL CANCELLATION-Penalties charged except special suppliers’ conditions
(applying only to individual costs per person and not lot cost due in total whichever number is)
1 As ground tour operator, Paris sur Scènes should select carefully its service providers and organise the trip or package with care.
2 If service provider is failing under Paris sur Scènes responsibility, Paris sur Scènes will be entitled to supply in compensation a service of equivalent or superior quality. In this case, no indemnity can be claimed.
For the avoidance of doubt, modifications as to the order or the schedule of the services, the replacement of hotel or restaurant by another of equivalent quality, or the replacement of one visit by another having equivalent interest, do not constitute modifications of an essential element where technical requirements render such changes necessary.
3 It should be specified that Paris sur Scènes responsibility for loss or damages incurred by client will exist, except if these damages are the result of “ force majeure ”, as specified in paragraph 4. If the alternative service is of inferior quality to the one planned at the origin, the amount of the indemnity will be limited only to this failing service.
INSURANCE AND GUARANTEE
Paris sur Scènes reminds its clients that they have to ensure that they satisfy the conditions for entering the territory of French legislation for health, customs and exchange control.
Paris sur Scènes is fully insured according to the French legislation of travel agencies by AXA insurance Company.
An insurance policy covering assistance, cancellation fees and lost luggage is highly recommended to subscribe by client, as it is not included in our services. The client, FIT or group leader should be informed by the organizing travel agent
All claims should be immediately transmitted to Paris sur Scènes and confirmed in writing, in order to find a solution on the spot. If this cannot be done, the detailed claim should be transmitted by mail within a deadline of 14 days after the end of the services.
After this deadline, the claims will no longer be accepted.
In case of dispute of any kind whatsoever, the Paris Trade Court of Commerce will be solely competent. Each party hereto submits to the exclusive jurisdiction of such court.
